The Terms & Policies (TOP) are the rules and regulations that specify guidelines for using our services. Use of our services is subject to these terms. Please read them carefully and ensure that you understand and agree to all parts. Use of PigeonHost services implies agreement with these terms ! The following guidelines were designed to ensure that our services remain of the utmost quality. Please read very carefully before ordering and/or using PigeonHost services.

PigeonHost will be the sole arbiter as to what constitutes a violation of this provision, and reserves the right to deactivate and remove any site at any time for any reason without refund.

Account Eligibility [v1 03/2019]

By registering for or using the Services, you represent and warrant that :
You are eighteen (18) years of age or older. The Services are intended solely for Users who are eighteen (18) years of age or older. Any registration, use of or access to the Services, by anyone under eighteen (18) is unauthorized and is a violation of this Agreement. If you use the Services on behalf of another party you agree that you are authorized to bind such other party to this Agreement and to act on such other party’s behalf with respect to any actions you take in connection with the Services.

It is your responsibility to provide accurate, current, and complete information on the registration forms, including an email address that is different from the domain you are signing up under. If there is ever an abuse issue or we need to contact you, we will use the primary email address we have on file. It is your responsibility to ensure that the contact information for your account, including any domain accounts is accurate, correct and complete at all times. PigeonHost is not responsible for any lapse in the Services, including without limitation, any lapsed domain registrations due to outdated contact information being associated with the domain. If you need to verify or change your contact information, you may utilize the PigeonHost Billing and Support Portal to update your contact information.

You agree to be fully responsible for all use of your account and for any actions that take place through your account. It is your responsibility to maintain the confidentiality of your password and other information related to the security of your account.

Any dedicated IP order in addition to those provided with a hosting package may be subject to IP justification. IP justification practices are subject to change to remain in compliance with the policies of the American Registry for Internet Numbers (ARIN). We reserve the right to deny any dedicated IP request based on insufficient justification or current IP.

[1] Website Transfers

Our Transfers Team will make every effort to help you move your website to us. Transfers are provided as a courtesy service. We do not make any guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult, if not impossible, to migrate some or all account data. In some cases we may not be able to assist you in a transfer of data from an old host. The free transfer service is available for thirty (30) days from your sign up date. Transfers outside of the thirty (30) day period will include a charge.

[2] Reseller Hosting Policies

[2.1] Reseller Client Responsibility : Reseller clients of PigeonHost are responsible for supporting their clients.PigeonHost does not provide support to our Resellers Clients. If a Resellers client contacts us, we reserve the right to place the client account on hold until the Reseller can assume their responsibility for their client. We reserve the right to charge said Reseller for services rendered to the Resellers client. All support requests must be made by the Reseller on their clients behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients.PigeonHost will hold any reseller responsible for any of their clients actions that violate the law or PigeonHost Terms of Service / Privacy Policy.If any Reseller account involved in doing Resource abuse or Unacceptable content abuse’s PigeonHost has rights to block the total Reseller since the accounts should maintain under the fair usage policy.Reseller’s are responsible for their clients how the accounts are being hosted.If we receive multiple abuse reports the total Reseller will be blocked and $50 Reactivation Fee should be paid to Reactivate the account.

[2.2] Fair Usage Policy (FUP) : User may not: a) Use 20% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc. b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. c) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers. d) Run any software that interfaces with an IRC (Internet Relay Chat) network. e) Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers. f) Participate in any file-sharing/peer-to-peer activities g) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc h) Run cron entries with intervals of less than 15 minutes. i) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”) j) Any accounts that is created without updating the nameserver or with out a DNS records Pointing to our servers will be removed with or without Notice.

[2.3] Unlimited Disk Space and Bandwidth : Unlimited disk space and bandwidth means there is no set limits on our packages. PigeonHost want you to have the resources you need to build your site without any limits. But, however we do need to make sure we continue to provide a full active service to all our customers. As such we do require all customers to be fully compliant with our Fair Usage Policy and Terms and Conditions. Customers on unlimited hosting packages this includes but not limited to shared hosting packages. As a customer of PigeonHost you agree to be subject to the following fair usage policy: The account will be primarily used for the purposes of web hosting. Unacceptable use include, but are not limited to, large file storage and making downloads of large files such as but not limited to media files, zipped folders and programme files. File downloads are permitted, but only in the context of a functioning website. The hosting account may not cause problems with performance of other hosting accounts hosted on the same server by making excessive demands on the resources of the server. This includes, but is not limited to, the CPU usage required to perform data processing on the account for the purposes of taking backups and other administrative tasks as well as the CPU usage required to actually serve the site on the hosting account. As a customer you agree that PigeonHost will be determining whether an infringement of this ‘fair use’ policy has occurred. Wherever possible, PigeonHost will propose alternative hosting arrangements should an infringement of this policy occur. These may include, but are not limited to, moving to a hosting plan with quoted disk space and bandwidth limits. If we identify an account that is not in compliance with our Fair Usage Policy or that has the potential to negatively impact the performance of our server, we will be required to temporary suspend the account. If this happens we will work with the customer in order to resolve the issue as quickly as possible. PigeonHost reserves the right to revise its policies at any time without notice. Before placing order please read our terms / privacy policy. We don’t offer SSH/Shell access to any user’s in Shared Environment on Any case.If you are looking for SSH Access you can consider taking VPS/Dedicated.

[3] Web Hosting Policies

[3.1] Shared Hosting Policies : Shared Hosting Packages You are not allowed to use the hosting for Backup Storage,File Hosting/File Sharing/Image Hosting,You are not allowed to Store any Personal Zip files or backup of your files as an Zip in the server.The hosting should contains only the Files used by the Website scripts.

[3.2] Definition of Unlimited Usage : Unlimited does not means set an arbitrary limit on the amount of resources an account can use. The accounts are not intended to support the greater web hosting needs of large enterprises or to be used as an online storage warehouse to store backups, archiving of electronic files or emails, documents, log files, etc. or to be used as a media file streaming/sharing hub. Reselling any of the Service’s resources is strictly prohibited. Any accounts found to be reselling resources will immediately be suspended, with or without notice. Reselling of account resources is only permitted if you are using a Reseller Hosting Plan, a Virtual Private Server (VPS) or a Dedicated Server.

Unlimited services are provisioned in a shared hosting environment. Any account found to be adversely affecting the performance of other Subscriber accounts by excessively using network bandwidth, server storage, memory or CPU resources, will be flagged by PigeonHost administrators and anti-abuse controls. These Subscribers will then be asked to consider Virtual Private Server (VPS) or Dedicated Server services. Serious offenses will result in the account service suspension or termination, with or without notice.

[1] Collection of Information

We collect various information when you register with Company, during your usage of our products and services, when you visit pages of our partners. We may combine information about you that we have with information we obtain from other partners or other companies in order to provide you a better experience or to improve the quality of our services. When you sign in to our services, you are not anonymous to us. We automatically receive and record information from your computer and browser, including your IP address, our cookie information, software and hardware attributes, the page you request and other standard browser parameters.

When you use our services, we send one or more cookies – a small file containing a string of characters – to your device that uniquely identifies your browser. We may set one or more cookies in your browser when you use our services or one of our partner’s services. Our infrastructure consists of servers deployed at multiple datacenters that are owned and operated by us or our partners. All information collected within our services resides on this network of servers.

We only use and process personal information for the purposes described in this Privacy Policy. In addition to the above, such purposes include :

Communicating with you. Making the sites or services easier to use by eliminating the need for you. Providing our services. Auditing, research and analysis in order to maintain, protect and improve our services. Ensuring the technical functioning of our network. Protecting our rights or property and that of our users.
Developing new services.
[3] No-Spam Policy

We have a strict No-Spam Policy prohibiting the use of any data collected to send spam. We will not sell any contact information to third parties.

[4] Choices for Personal Information

When you sign up for a particular service that requires registration, we ask you to provide personal information. If we use this information in a manner different than the purpose defined herein and in the terms of the services offered then we will ask for your consent prior to such use. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some of our features and services may not function properly if your cookies are disabled. You can decline to submit personal information to any of our services, in which case we may not be able to provide those services to you.

[5] Information Sharing

We only share personal information with other companies or individuals in the following limited circumstances :

We have your consent. Sharing the information with our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. We may share with third parties certain pieces of aggregated, non-personal information, such as the number of users by demographic. Such information does not identify you individually.
[6] Information Security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to our employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

[7] Accessing and Updating Personal Information

When you use our services, we make good faith efforts to provide you with access to your personal information and to correct this data if it is inaccurate.

Billing and Payment [v1 03/2019]

[1] Prepayment : It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree to pay for the Services in advance of the time period during which such Services are provided. Subject to applicable laws, rules, and regulations, payments received will be first applied to the oldest outstanding invoice in your billing account.

[2] Autorenewal : Unless otherwise provided, you agree that until and unless you notify PigeonHost of your desire to cancel the Services, you will be billed on an automatically recurring basis to prevent any disruption to your Services, using your credit card or other billing information on file with us.

[3] Late Payment : All invoices must be paid within invoice due date. Any invoice that cross due date then should be suspension or termination of Services. Access to the account will not be restored until payment has been received. If you fail to pay the fees as specified herein, PigeonHost may suspend or terminate your account and pursue the collection costs incurred by PigeonHost, including without limitation, any arbitration and legal fees, and reasonable attorneys’ fees. PigeonHost will not activate new orders or activate new packages for customers who have an outstanding balance on their account.

[4] Fraud : It is a violation of this Agreement for you to misuse or fraudulently use credit cards, charge cards, electronic funds transfers, electronic checks, or any other payment method. PigeonHost may report any such misuse or fraudulent use, as determined in PigeonHost’s sole discretion, to governmental and law enforcement authorities, credit reporting services, financial institutions and/or credit card companies.

[2] Refund Eligibility : Only first-time service user are eligible for the money back guarantee refund. For example, if you previously had or still have an account with PigeonHost and you canceled and signed up again for a new account, you will not be eligible for a refund. In addition, refunds are not offered for accounts that are suspended or terminated for violating our Terms of Service.

[3] Non-refundable Products and Services : There are no refunds on Domain Service, SMS Services, SSL Certificate.

Non-Acceptable Content [v1 03/2019]

All services provided by PigeonHost may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any law is prohibited. This includes, but is not limited to : copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless PigeonHost from any claims resulting from the use of service which damages the subscriber or any other party .

Spamming/Mail Bombing Services.
Live TV/Video Streaming.
Bulk Email related products.
Pornography/Nudity/Adult Content.
Hacking/cracking related websites.
Warez and/or copyrighted MP3s/Videos.
